TERMS AND CONDITIONS OF SALE USING MEANS OF DISTANCE COMMUNICATION AND PROVISION OF SERVICES BY ELECTRONIC MEANS

 

These Terms and Conditions define the rules for making purchases in the online store run by the Seller at www.koro.net.pl.

 

  1. Definitions
    1. The following Terms and Conditions define the rules and conditions for the execution of orders placed from 25.12.2014 and are a consequence of the entry into force of the Act on Consumer Rights of 30 May 2014 (Journal of Laws of 2014, item 827).
    2. The terms used in these Terms and Conditions have the following definitions:
      • Customer (Buyer, Consumer) – a natural person, legal person or organizational unit that is not a legal person, whose special regulations grant legal capacity to place an Order within the Store.
      • Online Store – an online store located at the electronic address of www.koro.net.pl, run and owned by the Seller.
      • Seller – The Seller is KORONET Spółka z o.o. with its registered office in Siedlce at 120 Brzeska Street, with the following numbers: NIP: 821-268-09-95, KRS: 0000992332, REGON: 523278070.
      • Goods – products presented in the Online Store.
      • Additional Service – a service provided by the Service Provider to the Client outside the Online Store in connection with the nature of the products sold.
      • Agreement – an agreement for the sale of the Goods offered by the Seller, concluded without the simultaneous presence of the Parties using the telecommunications network.
      • Order – a declaration of the Client’s intent, aimed directly at concluding the Sales Agreement, specifying in particular the type and number of Goods.
      • Parties – Seller and Buyer.
      • Order form – a form filled in when placing an order through the online store so that the order can be processed correctly
  2. General provisions for the provision of services by electronic means
    1. These Terms and Conditions define the rules for using the online store available at www.koro.net.pl
    2. Before starting to use the pages of the www.koro.net.pl online store, and especially before placing an order, the buyer should read the content of these terms and conditions.
    3. Making purchases through www.koro.net.pl requires the acceptance of cookies by the user’s browser.
    4. All products offered in the store www.koro.net.pl have been legally placed on the market Polish, are brand new, free of physical and legal defects.
    5. The content of the online store pages is www.koro.net.pl the property of the Seller and is legally protected.
    6. In order to use the websites of the online store, the www.koro.net.pl buyer should have access to a computer station or other device connected to the Internet with installed software that allows browsing the Internet.
    7. The photos of the goods placed on the website of the www.koro.net.pl online store are exemplary and are used only for presentation. Descriptions and photos placed under individual goods come from the Seller.
  3. Placing orders
    1. Orders are accepted via the website, by phone and by e-mail.
    2. Orders via the store’s website can be placed all year round 24 hours a day. Placing orders by phone or e-mail is possible only on working days during the hours specified on the store’s website.
    3. The order is effective if the ordering party correctly fills in all the fields from the order form, including contact details: the exact address to which the purchased goods are to be sent, the contact phone number and the e-mail address.
    4. In case of incomplete or incorrect data, the seller will contact the buyer. If it is not possible to contact the buyer, the seller has the right to cancel the transaction.
    5. The order procedure ends when the customer, after completing the data, choosing the payment and delivery method, and accepting the terms and conditions and consent in the order form, clicks on the „SEND ORDER” button. Performing this action means placing an order and concluding a purchase and sale agreement with KORONET Marta Zalewska for the products covered by the order.
  4. Shipping costs and timing
    1. The prices listed on the website do not take into account the shipping costs of the goods. Information about shipping costs can be found under the form that the buyer fills out to place an order. The costs of shipping the goods are charged to the buyer.
    2. Lack of information about delivery costs is tantamount to the fact that shipping costs are covered by the seller.
    3. The cost of shipping depends on the dimensions and the way the ordered goods are packaged. Orders made through the online store are processed only in the Republic of Poland.
    4. The goods are sent to the address indicated by the customer in the form, provided by phone or by e-mail. The seller is obliged to immediately inform in the event of an incorrectly completed order form, which prevents the shipment of the goods or may delay it.
    5. The seller allows the buyer to collect the ordered goods in person.
    6. If you choose the cash on delivery payment option, the shipment is sent within 24 hours from the moment of placing the order on business days. If you choose another payment option via bank transfer or the Przelewy24 system, the goods are sent after the payment has been credited.
    7. The Seller delivers the Goods through a courier company. After the Goods have been handed over by the representative of the courier company, the Ordering Party should check whether the Goods have no mechanical damage resulting from transport and whether the delivered Goods are in accordance with the Order. In the absence of damage or other reservations, the Ordering Party confirms the delivery of the Goods with a handwritten signature. In the event of mechanical damage to the Goods or non-compliance of the Goods with the Order, the Buyer has the right not to accept the shipment, then a damage report should be written by the courier, in which the damage will be described or the wrong goods, date and signature of the courier will be marked. The Seller should be notified of such a situation by phone or by sending an e-mail to the address provided on the www.koro.net.pl website. Checking the shipment upon receipt is a necessary condition for the Client’s possible claims due to damage, improper goods, or loss of the shipment in transport.
  5. Payment
    1. The products offered in the www.koro.net.pl online store have a net and gross price (increased by the value of 23% VAT).
    2. All prices are in Polish zlotys (PLN)
    3. The buyer has the option of paying:
      • by bank transfer to the indicated account number: PLN 07 1020 4476 0000 8902 0389 6222
      • payment via the Przelewy24 system
      • upon receipt of goods (for payment not exceeding PLN 15,000 gross)
    4. A personal VAT invoice or receipt is issued for each ordered product.
    5. A VAT invoice or receipt is attached to the ordered goods.
  6. Withdrawal from the contract
    1. A buyer who has concluded a distance contract has the right to withdraw from the contract without giving a reason by submitting a written statement. The right to withdraw from the contract is limited in time and is available for 14 days in accordance with the Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827).
    2. The period for withdrawing from the sales contract begins from the moment the buyer accepts the goods.
    3. The Buyer may withdraw from the contract by submitting a statement to the Seller. The statement may be submitted in writing to the Seller’s address or electronically.
    4. The Buyer shall be liable for any decrease in the value of the Goods resulting from the use of the Goods in a manner exceeding what is necessary to determine the nature, characteristics and functioning of the Goods.
    5. The right to withdraw from the contract by the Consumer is excluded in the following cases:
      • music and audiovisual recordings and computer programs stored on computer data carriers after the consumer has removed their original packaging;
      • goods (services) going beyond the standard offer of the store, prepared for a special order of the customer and tailored to their individual needs;
    6. In the event of exercising the right to withdraw from the contract:
      • the seller is obliged to return all payments made by the Buyer immediately, no later than within 14 days from the date of receipt of the Buyer’s statement of withdrawal from the sales agreement, including the costs of delivery to the Buyer.
      • the seller may withhold the refund of payments received from the Buyer until the Buyer receives the ordered Goods back or the Buyer provides proof of returning the Goods.
      • the buyer is obliged to return the Goods immediately within 14 days from the date on which he withdrew from the sales contract.
      • The customer only bears the direct costs of returning the goods.
      • The seller returns the payment to the bank account number indicated by the buyer.
    7. The Seller does not accept cash on delivery shipments sent by the Buyer.
  7. Complaint conditions
    1. Non-conformity of the goods with the order must be reported no later than 14 working days from the date of receipt of the shipment
    2. The warranty for the goods is provided for a period of 12 months, counting from the date of purchase
    3. Complaints should be submitted via the online form on the website: www.koro.net.pl or directly to your Technical and Commercial Advisor
    4. The shipment containing the complaint goods should be sent to the Manufacturer’s address: Brzeska 120 08-110 Siedlce
    5. The shipment must be accompanied by a copy of the documents confirming the purchase and the complaint number (RMA) written on the carton. Failure to meet these requirements will result in a significant extension of the complaint time or its failure to be considered
    6. In the event that the Client has made a purchase from a Distributor, the complaint should be submitted at the place where the purchase was made. The Distributor is obliged to deliver the advertised product to the Manufacturer.
    7. Complaint processing time – 14 working days, counting from the date of delivery of the complete shipment (together with the relevant documents) to the Manufacturer
    8. In the event of sending the goods back to the Manufacturer for repair (e.g. the saw broke outside the seal), the Client is obliged to send back the damaged goods with the appropriate information at their own expense. This service is subject to a fee.
    9. The manufacturer may recognize, reject or partially acknowledge the validity of the complaint
    10. If the complaint is accepted, the Manufacturer repairs or replaces the damaged product and delivers it to the Complainant at its own expense. If the complaint is rejected, the Complainant may collect the product within 30 days; In the event of failure to collect the complained product within the specified period, i.e. 30 days, the Manufacturer scraps the complained product.

Warranty rights are lost in cases where:

  1. The product has been used in a manner inconsistent with its intended purpose
  2. Interference with the product, including an attempt to repair
  3. The product has been mechanically damaged (e.g. fall, impact)
  4. Damage to the product has occurred as a result of external factors, e.g. through contamination, use in inappropriate conditions, as well as if the damage to the product was caused by the fault of the user (e.g. saws have not been lapped in, etc.)
  5. The product was used despite the defect
  6. The saw has microcracks

Failure to comply with the above rules may result in the customer being charged with the costs of handling the complaint.

 

  1. Personal data
    1. The Seller is the administrator of personal databases provided by buyers in connection with purchases.
    2. Personal data are protected in accordance with the Act of 29 August 1997 on the protection of personal data (consolidated text Journal of Laws of 2002 No. 101, item 926, as amended) in a way that prevents access to them by third parties.
    3. Personal data are used to fulfil the purposes of the sales agreement, therefore they may be transferred to entities responsible for the delivery of goods.
  2. Final provisions
    1. In matters not regulated in these Terms and Conditions, the provisions of generally applicable law, in particular the Civil Code and the Act of 30 May 2014 on Consumer Rights (Journal of Laws of 2014, item 827), shall apply.
    2. The Privacy Policy is an integral part of the Terms and Conditions.
    3. The Seller reserves the right to change these Terms and Conditions. The amendment to the Terms and Conditions shall enter into force within 14 days of its publication. Changes will be made available on the website of the www.koro.net.pl online store. Failure to accept the new wording of the Terms and Conditions means that it is not possible to use the online store and place Orders.

  4. You have the right to lodge a complaint with the President of the Office for Personal Data Protection if you believe that the processing of your personal data violates the regulations on the processing of personal data;
  5. Providing personal data is voluntary, although necessary for the proper performance of the contract. Failure to provide the data will result in the inability to provide the service you have chosen.
  6. The data provided by you will not be made available to third parties. Only institutions authorized by law will be the recipients of the data.
  7. The data provided by you will not be subject to profiling.
  8. The Data Controller does not transfer personal data to a third country or an international organisation.
